Is Delta 8 Flower Legal?
Yes, federally. Delta 8 flower is hemp-derived and contains less than 0.3% delta-9 THC by dry weight, which makes it federally legal under the 2018 Farm Bill. All Diesel Hemp delta 8 flower meets that standard. Several states restrict delta 8 specifically — check your local laws before ordering.
That definition changes on December 11, 2026 under Public Law 119-103, which also brings a cap of 0.4 mg total THC per container. You will read almost everywhere that delta 8 faces the earlier November 12 date because it is “synthetic” — that is not the test the statute uses, and the argument is more open than the headlines suggest.
