Delta 9 vs THC: Same Molecule, Different Legal Line
Delta 9 is THC. "Delta-9 THC" and "regular THC" are the same molecule, delta-9-tetrahydrocannabinol, with the same high and the same drug-test result. The only difference is the source plant and the law: hemp-derived delta 9 is federally legal when the product contains no more than 0.3% delta-9 THC by dry weight, which is 3 mg per gram. A 4 g gummy can hold 12 mg and still qualify as hemp. Marijuana-derived delta 9 is a Schedule I drug federally. On December 11, 2026, the federal hemp rule changes to count total THC, including THCA, and caps finished products at 0.4 mg per container.

Most pages that rank for this question stop at "they're the same thing." That is true, but it doesn't explain why a 10 mg delta 9 gummy ships to your door while a 10 mg dispensary gummy can't. The answer is a concentration rule written for plants, a 0.877 conversion factor for THCA, and the difference between delta 9 extracted from hemp and delta 9 made from CBD. Below: the at-a-glance table, the dry-weight math, effects and onset by format, a dose table, side effects and who should avoid it, how to read a COA, drug tests, state rules, flying, and which to buy.
We sell hemp-derived delta 9 gummies and THC coffee, so we have a stake in this. Every number below links to the law, lab report or study it came from.

Is Delta-9 the Same as Real THC?
Yes. When anyone says "THC" without a prefix, they mean delta-9-tetrahydrocannabinol. The "delta 9" names where a double bond sits in the molecule's ring. It acts as a partial agonist at the brain's CB1 receptors, which is what produces the high (Pertwee, British Journal of Pharmacology, 2008). The National Institute on Drug Abuse calls delta-9 THC the main intoxicating compound in cannabis.
The prefix spread after 2020 because hemp brands started selling delta 8 and delta 10. Once those needed names, the original became "delta 9," and shoppers reasonably assumed it was something new. It isn't. Even the FDA-approved THC drugs Marinol and Syndros contain dronabinol, which the FDA describes as synthetic delta-9 THC. Our Delta 9 THC encyclopedia entry covers the chemistry in depth.
Hemp-Derived vs Marijuana-Derived Delta 9: Why a 10 mg Gummy Can Be "Hemp"
The 2018 Farm Bill defined hemp as cannabis with no more than 0.3% delta-9 THC on a dry-weight basis. That is a percentage, not a milligram cap, and Congress wrote it for plants in a field. Applied to a finished product, 0.3% equals 3 mg of delta 9 for every gram the product weighs:
| Product | Weight | Max delta 9 at 0.3% | Typical label |
|---|---|---|---|
| Gummy | 4 g | 12 mg | 5–10 mg |
| Gummy | 3 g | 9 mg | 5 mg |
| 12 oz drink | about 340 g | about 1,020 mg | 5–10 mg |
| Hemp flower | 1 g | 3 mg delta 9 (THCA was not counted under the old test) | Sold as THCA flower |
So a heavy gummy or a canned drink can carry a full adult dose of delta 9 and still be "hemp." A marijuana gummy with the same 10 mg is legal only through a state-licensed dispensary. Same molecule, same milligrams, different plant and different paperwork.
That changes on December 11, 2026. Section 781 of P.L. 119-37, with its start date pushed back by P.L. 119-103 (signed September 2, 2026), redefines hemp by total THC, including THCA, and excludes finished products with more than 0.4 mg of total THC per container, according to the Congressional Research Service. A 10 mg gummy is 25 times over that line. The same law also excludes cannabinoids "synthesized or manufactured outside the plant." We track the bills that could change this on our hemp THC ban tracker and our hemp THC legal status page.
Extracted vs Converted Delta 9
Hemp-derived delta 9 reaches a gummy one of two ways, and the difference matters both for what you are eating and for the December 11 rule:
- Extracted. Hemp contains a small amount of delta 9. Extraction and distillation pull it out and concentrate it, often as a full-spectrum extract with CBD and minor cannabinoids. The molecule is never changed.
- Converted. CBD (usually isolate) is chemically isomerized into delta 9 in a reactor, the same type of process used to make delta 8. The result is still delta 9, but it is made outside the plant. Poor conversions can leave by-products and other isomers behind.
From December 11, 2026, converted cannabinoids fall outside the federal hemp definition even if the plant can make them (CRS IF13136). If a brand won't say whether its delta 9 is extracted or converted, assume converted. Our older explainer What the Heck Is Converted THC? goes deeper.
Delta 9 vs THCA: The 0.877 Math
THCA is the acid form of THC that the plant actually makes. Raw THCA does not produce a high; it does not activate CB1 the way THC does (Moreno-Sanz, 2016). Heat removes a carboxyl group and turns it into delta 9 (Wang et al., 2016). Because that group has mass, THCA can yield at most 0.877 of its weight as THC. The USDA rule uses this formula:
Total THC = delta-9 THC + (0.877 × THCA)
Our Lemon Cherry Gelato flower batch tested 33.18% THCA and 0.20% delta 9: 0.20 + (0.877 × 33.18) = 29.29% total THC. On the old product test it had only 0.20% delta 9. Once lit, it is 29% THC flower. That is why THCA flower and marijuana flower with the same total THC smoke the same, and why the new federal definition counts THCA. See THCA vs THC, Does THCA Get You High? and How to Read a THCA COA.
Delta 9 vs Weed: Does Hemp Delta 9 Feel Different?
At the same dose, no. "Weed" usually means marijuana flower, which you smoke, so the comparison people are really making is format: a smoked joint versus an eaten gummy. Smoked THC hits within minutes and fades in 2 to 3 hours. Eaten THC takes longer, lasts longer and often feels stronger, because the liver turns some delta 9 into 11-hydroxy-THC. A hemp delta 9 gummy and a dispensary gummy with the same milligrams feel the same.
Where they can feel different is everything else in the product. A full-spectrum extract carries CBD and minor cannabinoids, and some products add caffeine or melatonin. Our Hippie Speedball gummies, for example, add 10 mg of plant-based caffeine from guayusa, according to the product page.
Effects, Onset and Duration by Format
| Format | Starts | Peaks | Lasts |
|---|---|---|---|
| Smoked or vaped (THCA flower, vape) | Seconds to a few minutes | 15–30 min | 2–3 hours |
| Gummy or other edible | 30–90 min | 2–3 hours | 4–12 hours, depending on dose |
| Drink (emulsified) | About 15 min (per our THC coffee product page) | Varies | About 2 hours (per product page) |
Smoked and oral figures: Grotenhermen, Clinical Pharmacokinetics, 2003. Drink figures are from our own product page, not a study. Our Delta 9 Drinks vs THC Seltzer vs Edibles guide compares the formats in detail.
Common effects of delta 9 include euphoria, relaxation or sleepiness, changes in appetite, a faster heart rate, dry mouth and red eyes. At too high a dose, anxiety or panic, dizziness and trouble with thinking and coordination (Cleveland Clinic).
How Much Delta 9 Should You Take?
| Experience | Starting dose | Notes |
|---|---|---|
| New, or long break | 2.5–5 mg | Half a 5–10 mg gummy. Wait 2 hours before more. |
| Occasional user | 5–10 mg | 10 mg is the standard adult serving. |
| Regular user | 10 mg+ | Tolerance builds with daily use. Go up slowly. |
The most common mistake is taking a second gummy at 45 minutes because "nothing is happening." Edibles can take 90 minutes to start, and the second one lands on top of the first. Physicians writing about medical cannabis dosing suggest starting low, titrating slowly and generally keeping total daily THC at 30 mg or less to avoid unwanted psychoactive effects (MacCallum & Russo, European Journal of Internal Medicine, 2018).

Side Effects, Cautions and Who Should Avoid Delta 9
Hemp-derived delta 9 carries the same risks as any THC, because it is THC. Researchers have studied delta 9 far longer than delta 8, so its risks are better understood. Cleveland Clinic notes that regular use, especially at a young age, has been linked to a higher risk of addiction and possible effects on brain development and mental health (source). Practical rules:
- Don't drive or operate machinery. Edibles can stay active for many hours.
- Don't mix with alcohol. The effects stack.
- Skip it if you are pregnant or nursing, under 21, have a medical condition or take medication, unless your doctor says otherwise. Those warnings are on our own gummy label.
- Store gummies away from kids and pets. NIDA lists children eating edibles as a growing cause of hospital visits.
- Too much? Find a calm place, drink water and wait it out. Get medical help for chest pain, fainting or severe panic.
How to Buy Hemp Delta 9: The COA Checklist
Hemp delta 9 is not tested like a dispensary product unless the brand chooses to do it, so the certificate of analysis (COA) is your quality control. Check:
- Batch match. The lot number on the COA matches your package.
- Delta 9 in mg per serving, not only a percentage. That is the number that sets your dose.
- Delta-9 at or under 0.3% by weight, plus a total-THC line.
- Extracted or converted. Full-spectrum extracts show CBD and minor cannabinoids. A clean delta 9 peak with nothing else suggests isolate or conversion.
- An accredited lab (ISO/IEC 17025) you can look up.
- Contaminant panels where available.
Our COAs are on the Diesel Hemp lab results page, and the COA guide walks through reading one line by line.
Does Delta 9 Show Up on a Drug Test?
Yes. Standard drug tests look for THC-COOH, a metabolite of delta 9, and they can't tell hemp from marijuana. Federal workplace urine tests use a 50 ng/mL screening cutoff and a 15 ng/mL confirmation cutoff (HHS Mandatory Guidelines, 2017). Typical urine windows (Moeller et al., Mayo Clinic Proceedings, 2017):
| Use pattern | Approximate urine window |
|---|---|
| Single use | About 3 days |
| Moderate (about 4 times a week) | 5–7 days |
| Daily | 10–15 days |
| Long-term heavy use | More than 30 days |
If you are tested for work or sport, no hemp THC product is safe to use. More in our drug test guide and Does THCA Show Up on a Drug Test?.
Is Delta 9 Legal in Your State? (As of November 4, 2026)
Federally, hemp-derived delta 9 at or under 0.3% is legal until December 11, 2026. States layer their own rules on top:
| State | Hemp delta 9 status | More |
|---|---|---|
| Texas | Legal for 21+ with ID check; THCA and non-delta-9 isomers controlled since July 31, 2026 | Texas guide |
| Georgia | Legal; edibles capped at 10 mg per serving | Georgia guide |
| Tennessee | Hemp-derived THC limited to licensed 21+ retail since July 2026; no shipping into the state | Tennessee guide |
| Florida | See our dated state guide | Florida guide |
| Colorado | Diesel Hemp does not ship any products to Colorado | Legal status |
Laws change quickly. Check your state agency and the USDA hemp program before you order. This is general information as of November 4, 2026, not legal advice.
Can You Fly With Delta 9 Gummies?
The TSA's guidance says marijuana and some cannabis-infused products remain illegal under federal law, except products with no more than 0.3% THC on a dry-weight basis, as set by the 2018 Farm Bill. TSA officers don't search for drugs, but they must report suspected violations, and they refer anything they find to law enforcement. TSA doesn't say anything different for carry-on or checked bags.
In practice: a sealed, labeled hemp product with a COA is the safest way to travel, your destination state's law still applies, and international flights are a different matter. From December 11, 2026, most delta 9 gummies will no longer meet the federal hemp definition, so the exception TSA cites will no longer cover them.
Delta 9 vs Delta 8, THCP and CBD
- Delta 8 is an isomer with the double bond moved one carbon. It is milder, roughly half to two-thirds as strong, and almost always converted from CBD (FDA consumer update). See Delta 8 vs Delta 9 vs Delta 10 and THCA vs Delta 8.
- THCP has a longer side chain. In a lab assay it bound human CB1 receptors with a Ki of 1.2 nM (Citti et al., Scientific Reports, 2019), which is where "33 times stronger" comes from. That is receptor binding in a dish, not a measured human high. Our THCP entry explains the claim.
- CBD does not produce a high. It does not activate CB1 the way THC does, and in lab studies it acted against CB1 agonists (Pertwee, 2008). The FDA has approved one CBD drug, Epidiolex (FDA).
Which Should You Buy?

Frequently Asked Questions
Is delta-9 the same as real THC?
Yes. Delta-9 THC (delta-9-tetrahydrocannabinol) is the THC in dispensary cannabis, the compound that gets you high and the one drug tests look for. Hemp-derived delta-9 is the same molecule. What differs is the plant it came from and the law: under the 2018 Farm Bill, a hemp product may contain no more than 0.3% delta-9 THC by dry weight.
Will delta-9 get me high?
Yes. Delta-9 is THC, so a 10 mg hemp delta-9 gummy affects you like a 10 mg dispensary gummy. Edibles usually take 30 to 90 minutes to start working, peak at 2 to 3 hours and last 4 to 12 hours depending on dose. Start with 2.5 to 5 mg if you are new and wait at least 2 hours before taking more.
Does THCA get you just as high as delta-9?
Only after it is heated. Raw THCA does not get you high. Smoking, vaping or baking converts THCA into delta-9 THC, and the most it can yield is 0.877 times its weight. A flower testing 33.18% THCA and 0.20% delta-9 works out to about 29.29% total THC once lit, so it gets you high like marijuana flower with the same total THC.
Is delta-9 THC the strongest?
Delta-9 is the strongest THC that occurs in meaningful amounts in the plant. It is stronger than delta-8, which is roughly half to two-thirds as potent. THCP binds CB1 receptors more tightly in lab tests, but that does not prove a stronger high in people, and it is rare in the plant.
Is delta-9 stronger than regular THC?
No. They are the same compound. Milligram for milligram, hemp-derived delta-9 and marijuana THC produce the same effect. A product only feels stronger because it has more milligrams, a different format or a different mix of other cannabinoids.
Is delta-9 legal?
As of November 4, 2026, hemp-derived delta-9 is federally legal if the product contains no more than 0.3% delta-9 THC by dry weight. From December 11, 2026, the federal definition counts total THC and caps finished products at 0.4 mg per container, which most delta-9 edibles exceed. Several states, including Tennessee, restrict it further. This is general information, not legal advice.
Are delta-9 gummies safe?
For healthy adults at modest doses, the main risks are the familiar THC ones: impairment, anxiety, a fast heart rate, dizziness and dry mouth, and overdoing it with edibles. Do not drive, do not mix with alcohol, and skip it if you are pregnant, nursing, under 21 or take medication without a doctor's advice. Buy only products with a batch COA that lists delta-9 in milligrams per serving.
How much delta-9 should I take?
Start with 2.5 to 5 mg if you are new or it has been a while. 10 mg is a standard adult edible serving. Wait at least 2 hours before taking more, because edibles take 30 to 90 minutes to start working and a second dose lands on top of the first.
Can you fly with delta-9 gummies?
TSA says marijuana and some cannabis products remain illegal under federal law, except products with no more than 0.3% THC on a dry-weight basis. TSA does not search for drugs, but officers refer suspected violations to police. Your destination's state law still applies, and international flights are a different matter. After December 11, 2026, most delta-9 gummies will no longer meet the federal hemp definition.
Does delta-9 show up on a drug test?
Yes. Drug tests look for THC-COOH, the metabolite of delta-9, and cannot tell hemp-derived THC from marijuana. Federal workplace urine screens use a 50 ng/mL cutoff with 15 ng/mL confirmation. A single use is usually detectable for about 3 days, and heavy daily use can test positive for 30 days or more.
Delta-9 gummies vs THC gummies: what is the difference?
Usually none in the molecule. A hemp delta-9 gummy and a dispensary THC gummy both contain delta-9 THC. The hemp gummy has to stay at or under 0.3% delta-9 by dry weight, so it is sold online and outside dispensaries. Dispensary gummies follow state cannabis rules, often 10 mg per serving. Check whether the delta-9 is extracted from the plant or converted from CBD.
The Short Version
Delta 9 is THC. Hemp delta 9 and marijuana delta 9 are the same molecule with the same high and the same drug-test result. Hemp delta 9 is legal because the law caps concentration at 0.3% by dry weight, not dose, and that ends for most products on December 11, 2026. Buy extracted, batch-tested delta 9, start at 2.5–5 mg, and wait 2 hours.
